The advance sale of items through the portal https://aurax.tech (hereinafter, the “Portal”) is carried out by XPND TECHNOLOGIES, S.L., a Spanish company with registered address at Av. Santa Rosa dels Pins, 99, 08358 Arenys de Munt (Barcelona), holding Tax ID B-13919741, and registered in the Mercantile Registry of Barcelona, volume 48,849, page 153, sheet B-598,478 (hereinafter, “AURAX” or “we”).

AURAX is the sole distributor of the MouthX wireless controller, which can only be purchased through the Portal. We are not responsible for purchases made through other channels.

  1. Scope of Application

This document sets forth the conditions governing the advance sale (hereinafter, the “Pre-sale”) of the MouthX wireless controller from AURAX (hereinafter, the “Terms”), regardless of the digital medium, device, or platform through which you access it.

By purchasing under the Pre-sale model, AURAX offers you the opportunity to acquire the MouthX device before it becomes physically available and before its official commercial launch. Currently, MouthX is in its prototype phase and does not yet have the required “CE” (European Conformity) and “UKCA” (UK Conformity Assessment) certifications. 

For this reason, the product will not be effectively made available at this stage, but rather a conditional commitment will be established: the delivery of the device will be subject to the prior obtaining of the aforementioned certifications.

Consequently, the device will be supplied to the user only once these certifications have been obtained, thereby ensuring its compliance with the applicable regulations at the time of delivery.

Before placing an order, please read these Terms carefully, along with our Privacy Policy and Legal Notice. By purchasing on the Portal, you:

  1. Declare that you are over 18 years of age and have the legal capacity to enter into contracts;

  2. Agree to be bound by these Terms;

  3. Commit to not placing any false or fraudulent orders;

  4. Guarantee that the personal data provided is truthful and accurate.


  1. Personal Data

The information or personal data you provide will be processed in accordance with our Privacy Policy.

  1. Our Product

The Portal provides information about the MouthX wireless controller, including its features and price. AURAX strives to present an accurate representation of the product, but since MouthX is a customized product, we cannot guarantee that the colors and shapes displayed on screen will be identical to the actual product.

AURAX reserves the right to modify, withdraw, or restock the product offered to customers through the Portal at any given time. Product availability may be affected by demand, and in the event of stock shortages, we will inform you of alternative options, always respecting your rights as a consumer.

  1. Purchase Process Description

The purchase process on the Portal follows these steps:

  1. Review the features and price of the MouthX wireless controller on the Portal.

  2. Click the “start purchase” button and fill out a contact form with your personal information. We will contact you by phone to advise you and assess whether MouthX suits your needs. If you decide to place an order, you will receive a link to the payment page at the email address you provided.

  3. Alternatively, you can attend a demo session by clicking the “book your demo” button. At the end of the session, you will receive a payment link sent to the email address you provided in the demo registration form.

  4. The payment page will include the product description, quantity, and price in euros, along with delivery cost information. Make sure you have reviewed the product details and features before making your purchase.

  5. You must enter your contact, delivery, and billing information in order for us to process and ship your order. After entering your data, review the order details, select a payment method, and confirm the purchase by clicking “pay now.

  6. Once the order is completed, AURAX will automatically create a user account for you, accessible with your email address and a verification code. For future orders, you’ll be able to log in and your contact and delivery information will be pre-filled automatically.

  7. Every order constitutes an offer to purchase the listed products. Orders are subject to acceptance by AURAX. AURAX reserves the right to review an order beforehand and to refuse acceptance without just cause, without incurring any liability to the user or any third party.

  8. If you detect an error in your order before confirming payment, you may modify any detail from the payment page. If you detect an error after completing the payment process, please contact us at support@aurax.tech.

  9. Once the order has been placed, you will receive an email from AURAX confirming and accepting your order, along with the product details. Later, you will receive another email with instructions on how to complete a dental scan, along with the next steps. MouthX is currently in the prototype phase and, at the time of your order, will not yet have the CE and UKCA certifications.

  10. The purchase agreement will be formalized exclusively in Spanish or English.


  1. Prices and Payment Methods

All prices have been freely determined and offered in accordance with the principles of free and fair competition. Prices may change at any time; however, any such changes will not affect orders that are already in progress.

Accepted payment methods:

  • Credit and/or debit cards, specifically: Visa, Visa Electron, Visa Mastercard, Visa Maestro, Union Pay, Amex, Bancontact, iDeal.

  • Other payment options: Apple Pay, Google Pay, Shop Pay, and PayPal.

  • Accepted currency: We only accept payments in euros (EUR).

AURAX covers the shipping costs to the destination countries listed in the following section.

  1. Product Shipping

We ship to the following countries: Germany, Andorra, Austria, Bulgaria, Belgium, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Norway, Netherlands, Poland, Portugal, United Kingdom, Czech Republic, Romania, Sweden, and Switzerland.

The estimated delivery time will be indicated on the Portal. We will not be able to ship the product until it has obtained the required CE and UKCA certifications, in full compliance with applicable regulations.

Delivery will be considered completed once the user takes physical possession of the product, as evidenced by the signed receipt at the agreed delivery address.

  1. Taxes

All prices displayed on the Portal include Spanish Value Added Tax (“VAT”) at the current applicable rate. The final purchase price will be shown on the payment page, in accordance with the specifications detailed below.

8.1. Sales within the European Union (“EU”):

If you make a purchase from a country within the EU, the applicable VAT will be that of your country of residence. The corresponding VAT amount will be reflected on the payment page.

8.2. Ceuta, Melilla, and other special European territories:

If you make a purchase from Ceuta, Melilla, or other special European territories (such as the Canary Islands), VAT will not be applied. In such cases, you will be responsible for any local taxes, customs duties, and other import-related charges that may apply in those territories.

8.3. Sales to countries outside the EU:

For orders shipped outside the EU, the prices shown on the payment page do not include local taxes, duties, or import fees. Your order may be subject to local consumption taxes, customs duties, and other import charges, in accordance with the regulations of your country. The payment of these charges is the responsibility of the buyer and may be required by customs authorities at the time of delivery or customs clearance.

  1. Dental Scan

To begin manufacturing your personalized MouthX device, it is essential that you complete a dental scan following the detailed instructions provided by our team. You may carry out the scan at any dental clinic of your choice. Please note that the cost of the dental scan is not included in the price of the MouthX device and must be covered by you.

Once the dental scan is completed, you must follow the instructions provided by the AURAX team to submit the scan to us. It is important that the scan meets our specifications and quality requirements. If the scan provided is inadequate or does not allow us to manufacture your device, you will need to repeat the scan at your own expense.

  1. Exclusion of the Legal Right of Withdrawal

As the MouthX device is a customized product, manufactured exclusively for each user, the legal right of withdrawal from the contract does not apply, except in cases of manufacturing defects. If the product presents any defects, please contact us through the contact form available on the Portal or by email at support@aurax.tech

  1. Voluntary Right of Cancellation and Return

Notwithstanding the above, AURAX offers a voluntary right of cancellation and return, allowing the user to (i) cancel the order at any time from the moment it is placed until the product is delivered, or (ii) return the MouthX device within a maximum period of 30 (thirty) calendar days from the date of delivery, provided that the return conditions outlined below are met.

Product Return Conditions:

  • Moderate use of the device for testing purposes is permitted.

  • The product must be returned in good condition, clean, and disinfected.

  • In cases of excessive damage, visible dirt, or signs of misuse, AURAX reserves the right to apply a proportional reduction to the refund or, if applicable, reject the return.

To exercise your right of cancellation or return, you must send a return request via email to support@aurax.tech or through the contact form on the Portal. We will provide you with the postal address to which you should send the device.

Return shipping costs will be borne by the buyer. You will also not be entitled to a refund for your dental scan expenses.

Once the return is received, we will proceed with a full refund of the purchase amount paid, using the same payment method used for the original purchase.

Prevention of Abusive or Bad-Faith Returns:

If AURAX detects that the device was purchased solely for the purpose of testing and returning it without justified reason, such behavior may be considered to have been carried out in bad faith. In such cases, AURAX reserves the right to deny the refund in whole or in part.

Additionally, in cases of abusive or repeated use of the right of return, AURAX may impose restrictions on future purchases or deny the exercise of this voluntary right of cancellation and return.

  1. Warranty

In general, the measures set out in the warranty terms and conditions applicable under current regulatory law shall apply. In the event of defects in the delivered products, the user will benefit from the legal provisions regarding warranties and liability for defective products, without prejudice to any additional warranty that may apply.

AURAX will be liable to the user for any lack of conformity that exists at the time of delivery of the device. Such non-conformity will be resolved either (i) by termination of the contract, with reciprocal restitution of the goods and payments, or (ii) by free repair of the device, unless this proves impossible or would entail disproportionate costs for AURAX.

The legal period for claiming defects or lack of conformity is two (2) years from the date the user receives the device, and the user must retain the purchase invoice as proof.

However, for purchases made by consumers in Spain, Portugal, and Sweden, the legal period shall be three (3) years, in accordance with the applicable national legislation in those countries.

Shipping costs for defective products will be reimbursed once their condition has been verified and the validity of the claim has been confirmed.

AURAX’s liability in relation to any product purchased on the Portal shall be strictly limited to the purchase price of that product.

The warranty does not cover damage or deterioration resulting from improper, negligent, or incorrect use of the device, including but not limited to:

  • Unintentional pressure during sleep. MouthX is not designed for use while sleeping.

  • Eating or drinking while wearing the device (e.g., food, coffee, tea, soft drinks, etc.).

  • Exposure to extreme heat or prolonged direct sunlight.

  • Strong impacts, drops, or blows.

  • Unauthorized handling, opening, or modification of the device.

  • Sharing the device with other users.

  • Immersion in liquids or unauthorized chemical substances.


  1. Limitation of Liability

AURAX, its legal representatives, or agents shall be liable for breaches of essential contractual obligations deemed necessary for the execution of the contractual purpose, as well as for any claims from users involving harm to life, physical integrity, or health.

AURAX shall not be held liable for losses that are not attributable to a breach on its part, nor for business-related losses (such as, but not limited to, loss of profit, revenue, data, or unnecessary expenses incurred), or, in general, for indirect and/or consequential damages that were not reasonably foreseeable by both parties for the performance of the contractual purpose.

Under no circumstances shall AURAX be liable for any damages or losses—including injuries and/or death—resulting from the improper use of the device by the user.

The foregoing is without prejudice to applicable regulations on liability for defective products.

  1. Applicable Law and Jurisdiction

These Terms shall be governed by the laws of Spain, excluding the United Nations Convention on Contracts for the International Sale of Goods. This does not affect the non-waivable rights you may have under the laws of your country of residence.

Any dispute arising from these Terms may be submitted to the courts and tribunals of Barcelona (Spain) or to the competent courts of the user's country of residence (if located in a Member State of the EU).

  1. Modification of the Terms

AURAX reserves the right to modify these Terms at any time. Any purchase contract will be governed by the version of the Terms in force at the time the order is placed through the Portal.

  1. Electronic Waste Disposal (WEEE)

In accordance with regulations on Waste Electrical and Electronic Equipment (WEEE), the MouthX device must not be disposed of with household waste.

When you wish to dispose of your device, we recommend taking it to an authorized collection point or using a specialized recycling system for this type of product.
